Possible Roles that KM Can Play (Depending on Your Firm’s Structure and Resources:

Define

  • Developing templates (e.g. scoping, sample budgets)
  • Meeting with clients and lawyers to help with scoping and to identify their needs/potential solutions
  • Training lawyers on AFAs and value-based billing arrangements and on tools to assist them
  • Identifying and comparing comparable past matters, including contextualizing outcomes of related engagements along with the pricing models used

Plan

  • Developing matter/work plans
  • Reverse engineering past matters (by examining docketing, using AI-based tools, etc.) to identify variables
  • Creating/adapting phase/task codes to reflect the AFA
  • Identifying opportunities to integrate tech into workflows to increase efficiency and lower cost/price

Manage & Monitor

  • Liaising with the matter team to see where they are against budget and to support the efficient delivery of the matter
  • Developing or rolling out tools to manage tasks and track time against the AFA (assisting with communications, adoption and training)
  • Developing status report templates
  • Developing and deploying practice tools such as research platforms, document search and collaboration portals to streamline work processes and find efficiencies

Evaluate & Close

  • Developing debrief templates
  • Conducting matter debriefs with clients/lawyers to solicit lessons learned
  • Capturing data on factors that may have affected price, as well as any relevant practice data (e.g. how far the matter proceeded – e.g. did it end at Summary Judgment or at trial)
  • Refining and enhancing matter/work plans and budget templates to reflect lessons learned
