ABA Formal Opinion 477R states a lawyer is required to take special security precautions to protect against the inadvertent or unauthorized disclosure of client information, while Model Rule 1.6 (c) similarly states a lawyer shall make reasonable efforts to prevent unauthorized disclosure of, or unauthorized access to, information relating to the representation of a client. Shore v. Johnson Bell Ltd. demonstrates the demise of the attorney-client relationship due to lack of cybersecurity measures. And firms supporting financial and healthcare clients are bound to support FFIEC Appendix J and HIPAA, respectively.
