Pittsburgh: Practical Guidance on Data Management & Handling your Legal Holds

Fourteen years ago, Judge Shira Scheindlin announced in Zubulake vs. UBS Warburg that companies have a duty to preserve relevant data from the time they reasonably anticipate that a claim will be made. Since then, legal departments have struggled with managing legal holds and preserving evidence from hundreds or thousands of custodians over time spans that could last for years. A poorly executed hold can result in business disruption, unnecessary costs, and spoliation.

The Sedona Conference recently released the Second Edition of its Guidelines for Legal Holds for public comment. Our speakers, including a drafting team leader on the project, will speak about the Guidelines and the following topics:

  • The evolving law of legal hold and preservation obligations
  • How to effectively manage legal holds across multiple custodians
  • Consequences for failing to meet legal hold obligations
  • Dealing with international employees subject to legal holds

Speakers

Thomas C. Gricks, III, Esq., from Catalyst, is a licensed attorney in the Commonwealth of Pennsylvania and has been an active general commercial litigator for the past 30 years. He has practiced before both federal and state courts across the country. Mr. Gricks is currently admitted to practice in Pennsylvania as well as a number of federal jurisdictions, including the United States Supreme Court. For the past several years, Mr. Gricks has devoted a substantial portion of his practice to ediscovery, with a particular emphasis on technology-assisted review. He argued the Global Aerospace case before the Circuit Court in Loudoun County, Virginia, which is the first case to permit the use of technology-assisted review over the objection of the opposing party. He is a member of the Sedona Conference Working Group One and a frequent speaker on ediscovery and technology-assisted review topics. He has presented at continuing legal education seminars across the country, including the Sedona Conference Institute and the Georgetown Advanced Ediscovery Institute. He has also published a number of articles on ediscovery topics, including The Implications of Rule 26(g) on the Use of Technology-Assisted Review, 7 FED. CTS. L. REV. 239 (2013).

Joseph Decker, Esq., has been bit-x-bit’s Vice President and General Counsel since 2010, bringing 30 years of experience as a business litigator and trial attorney. Mr. Decker practiced law in San Francisco and Pittsburgh. He successfully argued the issue of taxation of ediscovery costs before the Third Circuit in the groundbreaking case of Race Tires America, Inc. vs. Hoosier Racing Tire Corp., 674 F.3d 158 (3d Cir. 2012). Joe’s responsibilities with bit-x-bit include business and market development, operations, client project management company legal matters. Joe is licensed to practice law in Pennsylvania and California and has appeared in trial and appellate courts throughout the country. He received his JD, with honors, from the University of San Francisco School of Law in 1985, where he was Articles Editor for the Law Review. He received his B.S. in Education, magna cum laude, from Syracuse University in 1976.
