A Potentially Fatal Intersection: Legal Holds and Electronic Records Management

Records management is the science (and some argue the art) of retaining records just long enough:  long enough to meet legal and regulatory requirements and business needs.  Of course, the business needs are to retain records that provide ongoing operational value, and IT’s charter is to preserve data for a very short period of time in case the building goes away.  Add a legal hold to the mix and things get interesting.  It’s at this intersection many fatal accidents occur.  It’s an exercise of balancing risk:  bust the seams on the IT infrastructure or risk some very bad days in court with potentially catastrophic consequences.
