Advances in technology enable parties to conduct discovery without relying on traditional linear or ‘eyes-on’ review models. We will discuss best practices and emerging case law for implementing technology to successfully manage ediscovery in a defensible, proportionate and cost-effective manner. We’ll cover topics including:

  • Ediscovery legal principles and obligations in Canada
  • Developments in Canadian case law and emerging policy developments
  • Analytics tools available in ediscovery review platforms
  • Incorporating review (TAR) in a defensible and proportionate manner

Presenter

Crystal O'Donnell is the founder and CEO of Discovery Counsel Professional Corporation. She has extensive experience as a litigation and ediscovery counsel, having practiced with a leading litigation firm and the Ministry of the Attorney General (Ontario), and has represented clients in many complex matters at all levels of the Ontario courts as well as in regulatory proceedings and investigations. Crystal’s range of expertise includes the legal, strategic and software aspects of ediscovery, and she has experience with cross-border and conflicts of laws issues which arise in multi-jurisdiction and multi-forum matters. This background gives her a keen appreciation and understanding of clients’ needs and allows her to deliver defensible, proportionate and cost-effective legal advice and solutions. Crystal is the Vice-Chair of the Board of Directors, CanLII, Steering Committee member of Working Group 7 of the Sedona Conference, and a member and past vice-chair of the Ontario E-Discovery Implementation Committee (EIC).
