Departing Attorneys – Matter Management, Security and Sanity

When asked to handle a departing attorney’s files you must consider matter management, security and your sanity. Jon Washburn discusses the final step in the life cycle of a matter, disposal, in a recent Life Cycle of a Matter blog post installment.  The “Matters from Laterals: A Matter Mobility Workshop” session at ILTACON 2016 offers great recommendations in the recording and a matter mobility task force report with pitfalls to prepare for, sample policy language and specifics on departing staff and attorneys. A discussion on best practices for departing attorneys begins on slide 23 of the ILTA webinar recording, “Best Practices for Attorney and Matter Mobility.” It includes recommended language to include in transmittal letters, suggestions of what to obtain in writing from a departing attorney and many questions to consider throughout the process. As you manage matters and their mobility, remember security. The “Improve Document Security and Monitoring” webinar from earlier in 2017 discusses methods to prevent unwanted data loss.
