Al, cybersecurity risk & regulation: new triad shaping data governance

Data governance will re-emerge as a critical business priority, shaping the future of risk management for firms around the globe. Re-assessing vulnerabilities and developing robust data governance strategies will move to the forefront. 

The need for and importance of this is already evidenced in the National Institute of Standards and Technology’s (NIST) Cybersecurity Framework 2.0 (CSF 2.0), the EU AI act, the EU"s DORA, and others which place newfound emphasis on governance and risk management. Rome wasn't built in a day - the building blocks to information governance

As more and more law firms transition to electronic and cloud-based document management and are exploring AI strategies, it’s emerging that alarmingly few are handing electronic data minimization systematically or well, despite the inherent cost, compliance and data security risks.

But, it can be difficult to know where to start when first considering an information governance strategy. The scale and breadth of the challenge, as well as the fast-moving pace of technological change can mean that it is a project that is often kicked further and further down the road. In doing so, the problem and indeed the mountain of data just gets bigger and bigger over time.

This session will discuss the benefits realized when firms proactively engage with a data minimization strategy:

From Theory to Practice: Implementing the ABA's Gen AI Guidelines

n July, 2024, the American Bar Association’s Standing Committee on Ethics and Professional Responsibility released Formal Opinion 512—its first formal opinion covering the growing use of generative artificial intelligence (GAI) in the practice of law, pointing out that model rules related to competency, informed consent, confidentiality and fees principally apply. As the Formal Opinion concludes, “With the ever-evolving use of technology by lawyers and courts, lawyers must be vigilant in complying with the Rules of Professional Conduct to ensure that lawyers are adhering to their ethical responsibilities and that clients are protected.”

This session will explore key guidance provided through the ABA Committee’s Formal Opinion 512, and offer practical strategies for incorporating the ABA guidelines into how lawyers and other legal professionals utilize GAI in the delivery of client services.
